Terms of service
The terms on which the PharmeXa platform is provided. Where a signed agreement exists between your organisation and Evyasys, that agreement takes precedence over anything here.

The service
PharmeXa is a platform for collecting, standardising and analysing pharmaceutical secondary sales data from stockist stock statements. It is provided by Evyasys on a subscription basis. What it does in detail is described under features and how it works.
PharmeXa is not a primary ERP. It does not perform billing, dispatch, invoicing or accounting, and it is not represented as a system of record for any of them. It reads what your stockists already export; it does not replace the systems that produce those exports. See integrations for the boundary in full.
Which document wins
Where a signed agreement exists between your organisation and Evyasys, that agreement takes precedence over anything on this page. These terms govern use of the platform where no signed agreement covers the point in question.
Accounts and users
Your organisation is responsible for who it grants access to, for keeping user records current, and for removing access when someone leaves. You are responsible for the accuracy of the stockist assignments you set against your representatives — those assignments determine what each person can see, so an out-of-date one is an access-control problem rather than a data-entry one.
Plans and fees
Subscription plans are described on the pricing page. Fees are billed monthly in advance unless agreed otherwise, and are exclusive of applicable taxes; GST is added as required by law. A change to your stockist or seat count takes effect immediately and is prorated for the remainder of the billing period.
Your data stays yours
Your stockist statements, your product master and the records derived from them remain your data. You grant us only the rights needed to host and process it in order to provide the service.
We do not use your data to train models for other customers, and we do not disclose it to other customers in any form — including in aggregate or anonymised form. Benchmark products built quietly out of customer data are common in this category, and we are not building one.
On termination we will return or delete your data as set out in your agreement. How it is handled while live is described in the privacy policy and on the security page.
Acceptable use
You agree not to:
- attempt to gain unauthorised access to the service, other accounts, or our infrastructure
- upload material you have no right to share, or that contains malicious code
- upload anything outside the platform’s scope — it is built for stock and sales movement between you and your stockists, and is not designed to hold other categories of data
- resell or provide the service to a third party without our agreement
- interfere with the service’s operation or its availability to other customers
- reverse engineer the platform except to the extent applicable law permits
We may suspend access where use breaches this section and presents a risk to the service or to other customers. Where circumstances allow, we will tell you first.
Accuracy of extracted data
PharmeXa extracts data from documents produced by third parties. We take care to do so accurately, and the approval workflow exists precisely so that a person reviews figures before they are relied on. You remain responsible for the commercial decisions you take on the resulting data, and for approving submissions before treating them as final.
Availability and support
We aim to keep the service available continuously and to carry out maintenance with as little disruption as possible. Support levels differ by plan, as described on the pricing page. Any committed availability target applies only where it is stated in a signed agreement — nothing on this website is an SLA.
Changes to the service
We may add, change or withdraw features. Where a change would materially reduce functionality you rely on, we will give reasonable prior notice to the contact on your account rather than announcing it on this page.
Term and termination
Monthly subscriptions may be cancelled with effect from the end of the current billing period. Either party may terminate for material breach that remains unremedied after written notice. Enterprise arrangements are governed by their own agreement.
Liability
Nothing in these terms limits liability that cannot be limited by law. Subject to that, and except where a signed agreement says otherwise, neither party is liable for indirect or consequential loss, and our aggregate liability is limited to the fees paid for the service in the twelve months preceding the claim.
Governing law
These terms are governed by the laws of India, and the courts at Ahmedabad, Gujarat have jurisdiction over any dispute arising from them.
